Massachusetts Issued Notice of Plastic Bags Warning Requirement

Department of Public Health, State of Massachuetts published a proposed regulation to amend 105 CMR: Plastic Bag and Plastic Film on Mar 25, 2016. The regulation is proposed to be amended to conform with labeling requirement used in other states so that warning labels appear on one side of certain plastic bags.

Warning requirement of plastic bag:

The length and width of which when added together totals 25 inches or more and the opening of which when shaped into the form of a circle has a diameter of seven inches or more; and the material of which is less than one mil in thickness, such plastic bag shall bear the following warning statement, or the equivalent thereof on its both sides:

"WARNING: To avoid danger of suffocation, keep this plastic bag away from babies and children. Do not use this bag in cribs, beds, carriages or play pens. This bag is not a toy."

In the case of bags whose total length and width is more than 40 inches, the label shall be repeated at 20-inch intervals.

The warning shall present in a prominent place on the plastic bag and shall be printed in legible type which shall be contrasted by typography, lay-out or color from the contents of the bag and from other printed matter on the bag. The font size shall meet as below:

BACL Reminds:
When products with plastic bags fallen into scope of this regulations, are exported to Massachusetts states, plastic bags shall add the correct warning label as requirement of this regulation, in order to avoid punishment of a fine caused by violation of provisions of 105 CMR 630.000.
