The Instituto Federal de Telecomunicaciones (IFETEL) of Mexico has opened a public consultation on November 13, 2023, on the Preliminary Draft Agreement which modifies Guidelines for granting the Certificate of Authorization (CoA) for the use of frequency bands of radio spectrum for secondary use. The Preliminary Draft Agreement includes the following proposals:

A recommendation by the 5G Committee:

●  Extending the Authorization validity for the Guidelines for Secondary Use, up to 20 years.

●  Providing legal certainty to Authorized Parties when requesting possible extensions, and ensuring the Guidelines for Secondary Use contain articles on the possibility for the Authorization to be extended for a period equal to or longer than the original validity period.

●  Establishing a deadline for submitting the request for a CoA as 60 Business days prior to the specific event or start of the frequency operations.

●  Extending the validity of CoA for secondary use for facilities intended for industrial or commercial activities to 7 years.

●  Considering information in the technical memory of the experimental concessions in the evaluation of the CoA request.

●  Considering the fixation for extending or modifying the CoA for secondary use.

The consultation will be open for comments until December 11, 2023.
