I.Definition

ODM mode: the factory is responsible for the design of products for one or more manufacturers

OEM mode: the manufacturer is responsible for designing the product and commissioning the product from one or more production plants

II.General requirements for ODM/OEM agreement

※ The document title should use “协议”or “合同”, not allowed to use “声明”or“说明”etc. The English agreement should use “Agreement” or “Contract”, not allowed to use “Declaration”.

※ When a file title uses an OEM or ODM abbreviation, the content of the file must not be inconsistent with the definition (see one) 

※ Not allowed to show “To China quality certification center (CQC)” or the similar description.

※ The agreement should specify the range of the cooperation, the products described in this agreement should cover the products in this CCC (or CQC) application.

※ The valid agreement retained by the factory shall be consistent with the agreement that uploaded when applying for certification.

※ All relevant parties (including the applicant, manufacturer, factory and the initial holder, etc.) shall be confirmed by the signature and stamp of the agreement

※ The agreement must specify who is the designer or intellectual property’s owner of the product；

※ The party responsible for the safety quality must be defined in the agreement

※ The agreement must specify the responsible party for the satisfaction of the certification requirements.

※ The agreement shall specify the effective date and expiry date of the agreement.

III.Additional requirements for ODM derived application protocols

1. 1.ODM derivative application. The agreement shall include a commitment from the original certificate holder to approve a derived certification client/manufacturer to take advantage of its certification results

2.  2.Factory should commitment to ODM holder/manufacturer of the product the producing conditions (including but not limited to the product design of key raw materials/components supplier quality management system and specifications , production process control process, flow chart, of production process, inspection test, etc.) and product certification conditions are identical

3. 3.For the ODM derivative application, the contract (agreement) needs to reflect the relationship between the certification product and the original product model
