On September 1st, 2017, Government of India Ministry of Commerce &Industry, Department of Commerce, Directorate General of Foreign Trade, published the Notification No.26/2015-2020. The Notification amends the Toy Import policy condition No.2 to Chapter 95 of ITC(HS).

The Notification came into effect on the date of its publication. Import of toys (all items under EXIM Codes 95030010, 95030020, 95030030, 95030090) shall be permitted freely when accompanied by the following certificated:

1. A certificate that the toys being imported conform to the standards prescribed by Bureau of India Standards (BIS):

1. IS:9873 (Part 1) – Safety of toys; part -1 Safety aspects related to mechanical and physical properties(3rd revision)

2.  IS:9873 (Part 2) – Safety of toys; part -2 Flammability(3rd revision)

3. IS:9873 (Part 3) – Safety of toys; part -3 Migration of certain elements (2nd revision)

4. IS:9873 (Part 4) – Safety of toys; Part -4 Swings, slides and similar activities toys for indoor and outdoor family domestic use.

5. IS:9873 (Part 7) – Safety of toys; Part -7 Requirements and test methods for finger paints

6. IS:9873 (Part 9) – Safety of toys; Part -9 Certain phthalates esters in toys and children’s product

7. IS:15644 – Safety of electric toys

    

2. A certificate that the toys being imported conform to the standards prescribed in IS;9873 Part-1, Part-2, Part-3, Part-4, Part-7, Part-9, and 15644:2006

3. A certificate of Conformance from the manufacturer that the representative samples of the toys being imported have been tested by an independent laboratory which is accredited by NABL, India and found to meet the specifications indicated above. The Certificate would also link the toys in the consignment to the period of manufacture indicated the Certificate of Conformity.
