The Ministry of Information and Communication (MIC) of Vietnam has opened a public consultation on December 25, 2024, on Regulations on conformity certification and conformity declaration for specialized information technology and communications products and goods. This Draft Circular will replace Circular 30/2011/TT-BTTTT, on the procedures for type approval certification and self-declaration of conformity for information and communication technology products. The Draft Circular includes new information regarding the ICT label.
The consultation will be open for comments until February 25, 2025.

3. Management and Oversight
The Department of Telecommunications is entrusted with state management of conformity certification and declaration for these specialized products. Local Departments of Information and Communications will work alongside this department to manage compliance in their respective areas.
4. Testing organizations
Organizations designated for testing must ensure the accuracy of test results, which do not substitute for certificates of conformity or declarations. Both designated and recognized testing organizations can conduct these assessments.
5. Product Lists and Management Forms
The circular outlines different lists of products:
-List of Products Requiring Certification: These must undergo conformity certification and be marked accordingly.
-List of Products Requiring Declaration: These must be declared in conformity and marked as such.
6. Financial Responsibilities
Organizations and individuals are responsible for covering the costs associated with conformity certification and declaration as per existing laws.
7. Conformity Certification Procedures
Conformity assessment methods must align with technical regulations. Certification organizations may directly assess production facilities or use subcontractors if necessary. Certificates of Conformity are valid for a maximum of three years, or for individual batches of products.
8. Conformity Declaration Procedures
For products requiring declaration, organizations may base their declaration on self-assessment results or certifications from recognized organizations. The procedure for domestically and imported products is defined by previous decrees and requires specific documentation.
9. Post-Certification Management
Organizations must maintain product quality and are legally responsible for compliance. If any product fails to meet certified standards, the organization must notify authorities, rectify the issue, and potentially recall non-compliant products.
10. Revocation and Re-declaration
Certificates of Conformity can be revoked if organizations do not comply with relevant regulations, and organizations must return revoked certificates. Re-declaration is required if there are changes in technical specifications, declaration content, or if a certificate expires.
11. Record Keeping and Reporting
Organizations must keep detailed records of conformity declarations and certifications, which should be presented to authorities upon request. This includes maintaining logs and reporting conformity activities to relevant governmental departments every six months.
12. Implementation Responsibilities
The Department of Telecommunications leads the implementation and enforcement of these regulations, guiding organizations and conducting inspections. Local departments will monitor conformity marks and maintain product quality within their jurisdictions.
13. Effective Date and Transition
The circular will take effect on a specified date and replace previous regulations. Existing certificates and declarations remain valid until their expiration date.
